TERMS AND CONDITIONS

Please read very carefully the following terms and conditions which contain important information regarding the rights and limitations of the customer and the site owner.

I. SITE AND SITE CONTENT

1- The rights of Gifts2Turkey.com web site belongs to NetPusula Bilgi Iletisim Sistemleri, Basri Kutlu YAVAS hereby, will be called as Gifts2Turkey shortly.
2- The media used in the site are subject to copyrights and can not be used in any form or any means including web publishing or printed materials without the written permission of Gifts2Turkey.
3- Gifts2Turkey reserves the right to make change in terms and conditions.
4- Gifts2Turkey can start or stop the site services anytime.

II. PRODUCTS

1- The products those listed in categories of Gifts2Turkey.com are third party products. Gifts2Turkey declares that the products will be delivered as seen in the picture, assuming the main reference to the product is the name and the definition listed with the products.
2- The products are limited with the stocks. Gifts2Turkey keeps the stocks up to date, but in case of any sold-out condition that may occur and the time to contact to customer is limited, Gifts2Turkey reserves the right to substitute the ordered product to equivalent.
3- Gifts2Turkey reserves the right to change the product catalog anytime. Gifts2Turkey accepts no responsibility to obtain the same product that has been listed in online catalog.
4- The declaration of the product by Gifts2Turkey will be assumed agreed upon by the customer for custom products.
5- Alcoholic beverages such as wines or spirits are legally limited for delivery to people whose age are of 18 and over. The recipient is being asked for the identification by a legally valid identification card, driving license, passport, etc. during the delivery. In case of the recipient over 18 of age cannot be found at the address, the product is returned back to the store, delivery and return costs are subject to be reserved from the credit card owner. The total of delivery and return costs are not limited with the delivery cost that has been stated during the order, please see "Order and Delivery" section of this document to understand clearly the meaning of "delivery cost".

III. PRICES, CURRENCY AND PAYMENT

1- Prices are in United States Dollars, the transaction for the payment is in Turkish Liras. The exchange rate for the calculation of the total amount to Turkish Liras is updated periodically.
2- Prices of the products can be changed without the prior permission of customers. The order and payment process is a contract between Gifts2Turkey and the customer.
3- The clearing of credit card transaction is made in Turkish Liras by local Turkish bank Garanti Bankasi. Thus the payment which will be seen on the statement by the customer in his/her local currency is based both the currency specified by Gifts2Turkey and the currency of customers credit card issuer. Any refund to a credit card will be based on Turkish Liras, may affected by currency fluctiations and therefore may not be completely same as the charged value.
4- The transaction on the customers credit card statement will be as "NETPUSULA GIFTS TURKEY".

IV. ORDER AND DELIVERY

1- Gifts2Turkey applies a "regular mean cost" that is stated as "delivery cost"in the payment form. Gifts2Turkey undertakes the delivery costs if the delivery cost is in tolerable limits. In any case of the product is returned to store by a reason related with the recipient or the customer such as legal limitations or incorrect address information, Gifts2Turkey preserves the right to not return the actual lost costs because of the undelivery depending on the Gifts2Turkey's own return costs because of the return, i.e. it is not limited by the two times of the "delivery cost" stated in payment form or such a criteria.
2- Gifts2Turkey reserves the right to demand additional fee for delivery if the delivery on conditions delivery requires special conditions or effort.
3- Delivery will only be made to the person specified in the order form.
4- In case of problem in delivery, including inaccurate or incorrect address, absence of the recipient at the address or any condition that the product cannot be delivered and returned back to the store, Gifts2Turkey reserves the right to demand additional delivery fee from the customer for redelivery.
5- Gifts2Turkey reserves the right to deliver products at any hour in specified date in special days such as valentines day, mothers day, etc.
6- Special delivery conditions apply to certain locations where a third party is involved, such as hospitals and hotels. In such cases, the signature of the person authorized to receive the order will be accepted as proof of delivery and fulfilment of the order.
7- A signed receipt is requested from the recipient during the delivery. That receipt contracts that the price of the products and additional fees will be paid by the recipient in case of the customer denies the placement of the order.
8- Delivery cannot be made to recipients under age 18 years old.
9- Orders cannot be accepted from customers under the age of eighteen (18) years. In case of a person under the age of eighteen (18) years places an order using parents credit card or any other credit card, the parents are assumed to be responsible for the order.
10- In case of any damage occurs in product between store to the recipient, the recipient should check and not receive the product from delivery person if found damaged.
11- The recipient will be called by the phone number indicated in the order form before the delivery. Delivery without a prior phone call is not accepted.
12- The time for the delivery cannot be earlier than 24 hours following the time of order. Gifts2Turkey is able to deliver products between 10.00-17.00 for delivery to Istanbul. Orders cannot be processed on sundays and on public holidays in Turkey.
13- The customer is responsible for delays in case the information provided about the recipient is not accurate.
14- Gifts2Turkey is responsible for delivery only if the information entered in forms are true and correct and the payment made successfully. In case of incorrect or missing information, Gifts2Turkey will contact to customer if the contact information is valid and accessible.
15- The name of the customer (sender) is clearly informed to the recipient during the delivery. Customer name will never be kept confidential from the recipient.

V. BILLING AND TAXES

1- Billing and taxes are based upon regulations of Turkish Ministry of Finance. The regular sales procedure applies as the foreign customer were buying the product from physical store in Turkey.
2- An official Invoice to be issued to the name of the customer after delivery of the product. The customer copy of the official Invoice is kept in Gifts2Turkey office that the sender can receive this copy but only by hand. Gifts2Turkey can but is not responsible to send the Invoice by postal methods. An invoice copy can be send to the customer by electonic mail but only on his/her demand.
3- The Value Added Tax (VAT) is applied and included within the prices. VAT is applicable due to the fact that the product is assumed to be consumed in Turkey.

VI. CANCELLATION OF ORDERS AND REFUND

1- Orders cannot be cancelled after 48 hours preceeding the delivery. Orders cancelled before 48 hours will be fully refunded. The refund will be in Turkish liras, the total refund may be affected by currency fluctuations.
2- Orders those cannot be delivered due to address or recipient problems can be redelivered on any day, subject to the cost of redelivery.
3- Customer can provide contact via e-mail address info@gifts2turkey.com for cancellation. Orders will not be cancelled until cancellation is confirmed by Gifts2Turkey.
4- The acceptability of the product by the recipient, is at the senders own risk. Gifts2Turkey preserverves the right of not return the payment paritally or completely depending its own return costs if the delivery is rejected by the recipient or delivery is legally impossible by the recipient.
